Appscio's Marks include, among others, the names Appscio™, Appscio Media Processing Framework™ and Appscio MPF™ (collectively the "Appscio Marks"). This list will be updated from time to time by Appscio as it develops new marks. Although many uses of Appscio's Marks are governed by more specific rules, which appear below, the following basic guidelines apply to almost any use of Appscio's Marks in printed or electronic materials (including websites):
- Proper Form - Appscio's Marks should be used in their exact form -- neither abbreviated nor combined with any other word or words;
- Appearance of Logos - Appscio's Marks (including logos) shall be consistent with Appscio's own use of the Mark in comparable media.
- Accompanying Symbol - The first or most prominent mention of an Appscio Mark should be accompanied by a symbol indicating whether the mark is a registered trademark ("®") or an unregistered trademark ("™");
- Notice - The following notice should appear somewhere nearby (at least on the same page as) the first use of a Appscio Mark: "[TRADEMARK] is a ["registered", if applicable] trademark of Appscio, Inc.";
- Distinguishable - In at least the first reference, the Mark should be set apart from surrounding text, either by capitalizing it or by italicizing, bolding or underlining it.
General Restrictions Upon Use
Without limiting the foregoing, the Appscio Marks shall not be presented or used:
- in a manner that is misleading, defamatory, libelous, obscene or otherwise objectionable, in Appscio's reasonable opinion;
- in a way that infringes, derogates, dilutes or impairs the rights of Appscio in the Appscio Marks;
- as part of a name of a product or service of a company other than Appscio, except as expressly provided herein or in a written agreement executed by Appscio;
- in the plural or possessive form;
- in a manner that merges any Appscio Mark with other words, symbols, or numbers, either as one word or used as a modifier (with a hyphen).
Without limiting Appscio's other remedies, any user will promptly make any changes to its use of an Appscio Mark as requested by Appscio. These Guidelines may be modified at any time by Appscio.
Software Distributions
Unaltered Binaries
You may distribute unchanged official binaries downloaded from Appscio to anyone in any way subject to governing law, without receiving any further permission from Appscio. However, you must not remove or change any part of the official binary, including Appscio Marks. On your website or in other materials, you may truthfully state that the software you are providing is an unmodified version of an Appscio application, keeping in mind the overall guidelines for the use of Appscio Marks in printed materials, detailed above.
Source Modifications
Those who make significant functional changes to open MPF Code may not redistribute that software under any Appscio Mark. For example, it would be inappropriate for them to say "based on Appscio MPF". Instead, in the interest of complete accuracy, they should describe their executables as "based on Appscio technology", or "incorporating Appscio source code." They should also change the name of the executable so as to reduce the chance that a user of the modified software will be misled into believing it to be a native Appscio product.
Extensions and Plugins
At the same time as it seeks community involvement in the development of its products, Appscio wants to protect the reputation of its products in the market. If you want to ship extensions or plugins installed by default or as part of the same installation process as the Appscio products, and you plan on distributing them under any Appscio Marks, you must first seek approval from Appscio.
Related Software
Appscio products are designed to be extended, and Appscio recognizes that community members writing extensions need some way to identify the Appscio product to which their extensions pertain. Appscio's main concern about extensions is that consumers not be confused as to whether they are official (meaning approved by Appscio) or not. To address that concern, Appscio requests that extension names not include, in whole or in part, the words "Appscio", "MPF", or "Media Processing Framework" in a way that suggests a connection between Appscio and the extension (e.g., _____________________).
Linking and Domains
So long as you don't do anything that might confuse visitors to your website, or that might violate the our Trademark Policy or other policies, Appscio invites you to link to Appscio's website, including for the purpose of allowing your visitors to download the Appscio MPF Code. If you want to include all or part of an Appscio Mark in a domain name, you have to receive written permission from Appscio.
Services Related to Appscio Software
If you offer services related to Appscio software, you may use Appscio's Marks in describing and advertising your services, so long as you don't violate these overall guidelines for the use of Appscio's Marks or do anything that might mislead customers into thinking that Appscio has any direct relationship with your organization.
